Sir,

Please find enclosed circular issued by the HRD wing of the CBDT dated 15/7/2011 which is self explanatory.  In this context, we might recall your attention to a discussion with you on the same subject few weeks back.  You had promised that the demand of retention of those promoted OS & Steno-I  will be considered on the receipt of any directions from the CBDT.  Now on the basis of this we may request you to set right some of the previous transfer orders issued in the above two cadres.  This may be made in the ensuing postings consequent to the DPC.

2.       This year no transfer and postings were made in the cadre of Stenographers.  One Mr. Shaji who on promotion as ITI was transferred fromTrivandrumand posted at Trichur had been reverted as Stenographer.  On reversion to the cadre of Stenographer he was not given posting at the previous station viz.Trivandrum.

3.       Similarly one Mr. Lali who completed 3 years at Ernakulam, was not considered for a home town transfer to his native place i.e. Kollam.  In Kollam one Steno’s vacancy has been filled in by redeployment of a lady.  This has blocked the chances of aspirants among the working staff.  Therefore we request you to issue transfer orders in the cadre of Stenographers at the earliest.

Sub: Procedure for regulating claims of ITIs for reimbursement of the cost of 30 liters of petrol – request for withdrawal of letter dated 02/03/2010 issued by the CCIT(CCA), Kochi – Reg.

As per the Board’s letters under reference No.1, ITIs  in the Income Tax Department has been drawing an amount equal to the cost of 30 litres of petrol for the reimbursement of Local Travel expenses. It had further been amended Board’s letter under reference No.2 which superseded all the previous circulars issued by the CBDT in this regard. Since then, Inspectors working all over India have been drawing the amount without fail, except those working in Kerala Charge. By the letter under reference No.3, then CCIT(CCA), Kochi issued a circular to restrict the claims of petrol allowance submitted by the ITIs. The above circular made innumerable hindrances in several offices by passing the Board’s Instruction dated 31/03/2000. On representing before the former Chief Commissioner of Income Tax (CCA), Kochi Shri Christropher Abraham, he leniently considered out representation and withdrew the circular under reference No.3 by his letter dt:30/11/2009 given in reference No.4. Again, during your tenure, the same circular as per reference No.3 was issued in your letter dt:02/03/2010. During the last quarter of the financial year few of the Commissioner declined to pass the bills on the basis of the wordings in your letter.

This issue was a hot discussion in the Secretariat meeting of the Income Tax Employees Federation, New Delhi raised by me on behalf of the Kerala Circle and they have directed me to represent before the Kochi Chief Commissioner  to withdraw such circular other than issued by the CBDT in its letter dated 31/03/2000, hence this letter. No other charge has issued such a letter other than Board’s letter which is self explanatory. In the last Executive Committee Meeting of the Income Tax Employees Federation, Kerala Circle held on 15/07/2011 all branches pointed out the complaints regarding the objections on such claims both by Heads of Offices and Zonal Accounts Office.

We on behalf of the Executive Committee Meeting of the Income Tax Employees Federation, Kerala Circle, request the Chief Commissioner of Income Tax (CCA), Kochi to withdraw the circular dated 02/03/2010 and necessary direction may be given to all Heads of Offices to abide by the Board’s Circular dated 31/03/2000 in all the claims submitted by the Inspectors.

Sir,

The Executive Committee Meeting of ITEF,Kerala Circleheld on 15-07-2011 unanimously  decided to request the Chief Commissioner of Incometax(CCA),Kochi  to convene the Departmental Promotion Committee and issue orders of  Gr. B-non gazetted, Gr.C  staff.   DPC for this recruitment year  is long pending .  The delay causes financial loss to a number of staff who are in the promotion row.  It is learnt that the DPC is not being convened because of some court orders.  If any court order prevents the authority  to convene the DPC, concerned court may be contacted  to give appropriate directions  for convening the  DPC.

The DPC for PS  is learnt to have been kept pending for want of recruitment rule for the merged cadre of Stenographer Gr.I & II.  However there is recruitment rule for PS and there are qualified earstwhile stenographer Gr.I. The court stay order does not prevent from convening DPC in this cadre. Therefore non-convening of DPC for this cadre is against the administrative ethics.

Dear Comrade,

Quarterly formal Meeting with the Chairman, CBDT.

The quarterly formal meeting with the Chairman, CBDT was held today As demanded by the ITEF, the first agenda for discussion was the review of the implementation of the decisions taken at the last meeting held on 19.4.2011. We give hereunder the outcome of the discussions.

1. Equal distribution of workload. Orders have been issued on 15.07.2011.

2. Mobile Hand set and silver coins as gift on the occasion of the 150th anniversary. The Department of Expenditure has not agreed to the proposal of the Board to provide silver coins to all employees and officers on the occasion of the 150th anniversary. The issue of providing mobile set is being taken up with the Department of Expenditure.

3. Advance increment on passing the Departmental Examination for Sr. T.As and Stenographer. II. The DI(HRD) has prepared a detailed note for submission to the Department of Expenditure in the matter. The Note would be subjected to discussion with the ITEF representatives on 21st and on reaching agreement would be placed for the consideration of the Department of Expenditure.

4. Allocation of funds for Medical/TA/Conveyance: It was stated that Rs. 22 crores have been allotted to different charges for meeting the medical bills. As per the information with the Director (Budget), only 20% of it has been spent so far. If any charge faces insufficiency of funds, they may take up the matter with the Board for immediate sanction. In respect of TA also, it was stated that sufficient funds have been allotted. If any charge is experiencing shortage in the matter, the same may be brought to the notice of the Director (Budget) for sanction of additional allocation. The representatives were informed by the official side that in some charges the funds allocated for the purpose of conveyance (Notice servers and Inspectors) are not being utilized at all. The concerned Circle Secretaries are requested to take up the matter with the Chief Commissioners and ensure that the impediments in the sanction of Conveyance allowance i.e. reimbursement of Petrol/diesel charges are removed.

5. Regional Recruitment of Lower Staff. While the erstwhile Group D posts ( which have now been converted as Group C (MTS) would continue on the regional basis, the filling up of posts of Tax Assistants and above would not be possible to be done on regional basis in view of the Supreme Court orders. However, the SSC has agreed to indicate the number of vacancies charge wise while inserting advertisement.

6. Departmental Examination to be conducted in June/July every year. From next examination onwards, these examinations would be conducted in June,/July every year. The time table for this years examination has already been issued in consultation with the representatives of the ITEF. The provision of calculators at the Examination hall which had been prohibited by an earlier order of the Directorate had been taken up by the ITEF and the same has been rescinded.

7. LPC to follow transfer guideline. Orders have been issued.

8. The personnel on promotion as OS. Having no financial benefit would not be transferred out of station.

9. Restoration of Special pay. The issue is being taken up with the Department of Expenditure and Personnel.

10. Cadre Restructuring. The Board has replied to the queries raised by the Department of Personnel and the issues are being discussed with the Department of Personnel. The Chairman has agreed to call on the Secretary, Personnel to expedite the matter.

11. Cadre composition. The matter will be settled before the issuance of orders on account of cadre restructuring.

12. Fixation of pay in the case of Inspectors on up-gradation of pay scale. The Chairman has asked the DI(HRD)_ to issue the requisite clarification immediately.

13. The Chairman has agreed to issue necessary instruction to the Chief Commissioners to effect promotion on adhoc basis to the grade of Income tax officers, wherever the matter is pending in the Tribunals.

14. The Member (P) has been entrusted to look into and resolve the issue brought to the notice by the ITEF representatives of the problem faced by the employees and officers of Orissa Charge on account of the attitude of the Chief Commissioners.

15. The Chairman has directed all concerned in the Board to endorse the copies of the orders issued by them to the field formation to the ITEF.

150th year celebration.

We invite your reference to the Circular No.5 of the Federation dated 12.07.2011 on the above subject in which we had conveyed the decision of the Sectt.. The Sectt. had to take the decision of boycotting the functions in the light of the negative attitude of many Chief Commissioners in eliciting the participation of the employees. The Chairman has now written to all the Chief Commissioners to ensure that a feeling of oneness amongst all section of the employees by eliciting the participation of staff members and their representatives in these functions is created. Copy of his letter is reproduced. We have also been informed by many circles that the respective CCITs have invited our representatives to participate in the Committee set up for this purpose. In view of this development the following decisions are taken.

(a) Wherever the CCITs have elicited our co-operation in the decision making process onwards, we must participate in the function.

(b) Where the CCITs have merely extended an invitation, the circle Executive Committee must meet and take appropriate decision.

(c) Where the CCITs have neither included our representatives in the committee and nor extended the invitation, the functions must be boycotted.

We have been informed by the Orissa circle General Secretary that the CCIT has ignored the ITEF and ITGOA while deciding upon the function. The CCIT Orissa is reported to have been taking an anti-employee stand in all matters leading to various agitations in the last six month. They have therefore decided not only to boycott the function of the Administration but also to organise a parallel function under the auspices of theJCA Orissa Circle. We fully endorse this decision.Com. President and Secretary General of ITEF have decided to participate in the function organized by the Orissa State JCA

            As per the letter referred to above ITIs were requested to donate Rs.500/- to our organization.   So far, few branches have collected and remitted the amount to the Headquarters.   In the Executive Committee Meeting of ITEF, Kerala Circle, most of the Branch Secretaries have reported that few of our ITIs are reluctant to pay the amount.   It may be reminded that only by our united effort of all staff including those other than ITIs we could achieve this demand.    Therefore, a small amount from the increased benefits consequent to up gradation,  may be spared for expenditure towards the renovation works of  Central Headquarters building by way of your donation. .    Branch Secretaries may contact all the Inspectors working in your Branch and collect the amount  and remit it to the Head Quarters latest by 05-08-2011.   A list of non-remitters may be sent to the Circle headquarters.

Dear Comrade,

 

            As requested over telephone, the following issues may be taken up the Board Chairman, in the proposed meeting to be held on 20-07-2011.

 

  1. 1.      It is heard that the Department can issue relevant orders to grant one increment in the case of OS on promotion from STA without much hindrance.  However it is delayed without much reason.   This is to be taken up seriously.
  2. 2.      The issue of granting two advance increments to STA for passing  ITIs Examination is to be ensued. In the recently concluded executive committee meeting members requested to grant the advance increments to all those in the  Grade Pay of .2400/ & 4200/-  instead of restricted to STA.   This is a vital point.
  3. 3.      The MACP to the interstate transferees in Kerala is granted when they acquire 20 years of service.  At that stage only first MACP is being granted.   The authorities say that clarifications have to be obtained from CBDT to grant the second one.
  4. 4.      There is acute shortage of TA fund in Kerala Charge.  Even those are selected for Training are not getting their advance before proceeding to their training.
  5. 5.      Regional Sports and Cultural  Committee   Kolkota has in its letter dated 20-06-2011  issued a circular that first All-India Cultural Festival of the Incometax Department will be held from 8th to 10th of September,2011 in Kolkata.   In Kerala we are celebrating Onam festival therefore we are not able participate in the programme.  Onam is a national festival.   Therefore we request to postpone or prepone the dates.

            Sub:               Recovery of Pay and Allowances in lieu of strike observed on 7-9-2010,

                                      20-08-2008,30-10-2007 &25-07-2001 by the JCA of ITGOA & ITEF-reg.

            With reference to the above, JCA of ITEF and ITGOA request the Chief Commissioner of Incometax(CCA), Kochi  to consider  the following points before giving effect to the pay cut on the above days.

 

1.          No pay cut shall be enforced unless the Administration has proper record  to evidence that the  government servant had participated in the strike.

 

2.          No pay cut shall be effected unless the Administration records satisfaction with  reference to the relevant Pay Registers(A quittance Registers), that      no pay cut has ever been effected for participating in the3 same strike.

 

3.          The government servant shall not be required to state whether he had  Participated in the strike or not.

4.          The terms of settlement of each strike shall be ascertained, and it shall be  ensured that there had been no agreement by the CBDT to treat the strike period as eligible leave.

5.               For any pay cut effected, appropriate entry shall be made in the Service   Register of the government servant.
